I rule that Mr. Frankel's vote will count, and Mr. Meyers will not.
Therefore, I accept your tabulation and roll call as final, and declare Mr.
Blau to be our new Secretary.
Thank you for serving as temporary Secretary, and I trust you will continue
your role as assistant to the Secretary, and hope you can assist Mr. Blau as
he transitions into his new role.

Dear Chairman Neale:
I hope all is well with you. I am writing in my capacity as Secretary
Pro Tem to provide you and our LNC colleagues with the results of the vote
to select the secretary of the LNC.
Text of Motion:
The vote to select the secretary of the Libertarian National Committee will
proceed as follows:
On each ballot, a member of the Committee will cast a vote for at most one
person on the list of candidates, or cast a vote for "None of the Above."
The candidate who receives a majority of the votes cast on a given ballot is
selected to serve as secretary.
Should no candidate receive a majority of the votes cast on a given ballot,
a subsequent ballot will be distributed. Candidates who received 0 votes on
the given ballot will not be included on the subsequent ballot. In
addition, of those candidates on the given ballot who received at least 1
vote, the person with the fewest votes will not be included on the
subsequent ballot.
The voting process will continue until a ballot produces a candidate who
receives a majority of the votes cast on that given ballot.

Blau, David
Mattson, Alicia
Moulton, Chuck
As of the close of the voting period at 12:00 p.m. EST today
(Wednesday, Feb. 20), the vote totals are as follows (candidates listed in
decreasing order of vote totals):
Blau: 10 votes (Blau, Cloud, Hinkle, Kirkland, Lark, Mack, Neale, Pojunis,
Visek, Wiener)
Moulton: 6 votes (Frankel, Hagan, Olsen, Starchild, Vohra, Wrights)

Abstention: 1 (Redpath)
(Since Alicia Mattson withdrew her name from consideration during the voting
period, and since those who voted for her changed their votes prior to the
close of the voting period, I have not listed her above as a candidate.)
Note: Mr. Goldstein (Region 3 alternate) voted for Mr. Blau; his vote is
superseded by the vote (for Mr. Blau) by Ms. Mack. Ms. Capozzi (Region 4
alternate) voted for Mr. Blau; her vote is superseded by the vote (for Mr.
Blau) by Mr. Pojunis. Dr. Lieberman (Region 4 alternate) voted for "None of
the Above." His vote is superseded by the vote (for Mr. Blau) by Mr.
Wiener. Mr. Blau (Region 5N alternate) voted for Mr. Blau; since Mr.
Tomasso did not vote, Mr. Blau's vote will serve as the vote of Region 5N.
Mr. Frankel (Region 7 alternate) voted for Mr. Moulton; issues regarding
this vote are indicated below.
I request that you and our LNC colleagues review the list of votes and
associated voters above and the list of voters and vote submission dates
below to determine whether any corrections are needed. Please note that I
have copied Mr. Moulton with this message. (Mr. Blau will receive a copy of
this message in his capacity as an LNC member.)
There are two issues concerning the disposition of the ballot that
require your attention as chair (and ultimately the attention of the LNC):
1) John Jay Myers announced his resignation as the Region 7 representative
in a message to the LNC-Discuss list at 12:04 a.m. EST today. I assume from
the language of his message that his resignation was effective immediately
(absent specification to the contrary, I believe such messages should be so
interpreted).
Thus, in my opinion his vote should not be recognized; indeed, I doubt
anyone will contend otherwise. However, as a matter of proper procedure I
believe it is appropriate for you in your capacity as chair to confirm
whether his vote should be recognized.
2) I have listed the vote for Mr. Moulton by Region 7 alternate Paul
Frankel in the vote totals given above. Mr. Frankel cast his vote for Mr.
Moulton in a message to the LNC-Business list at 11:49 a.m. EST on Sunday,
Feb. 10.
However, the voting period did not open until 12:00 p.m. EST that day.
Thus, technically speaking, Mr. Frankel's vote was not submitted during the
voting period. I mention this because I believe Mr. Myers' vote should not
count, and that Mr. Frankel's vote (if considered valid) should represent
the vote of Region 7.
Again as a matter of proper procedure, I believe it is appropriate for
you to rule whether Mr. Frankel's vote will count. (Fortunately, this issue
will not have an impact upon the selection of the secretary.) If you
proceed in this manner, I believe you should rule in favor of counting Mr.
Frankel's vote. I suspect he assumed that voting would begin as soon as the
ballot was distributed. Incidentally, the voting period was set to open at
12:00 p.m. on Feb. 10 so that the period would close at 12:00 p.m. on Feb.
20, in the hope of making it easier for members to remember the deadline.
