All,
We have an opportunity to sign on to an amicus brief in support of en
banc rehearing in U.S. v. Houston. A former colleague of mine works
for the firm handling the amicus for the National Association of
Criminal Defense Lawyers and the Brennan Center.
For background on the Houston case, this Ars Technica article may be
helpful. http://arstechnica.com/tech-policy/2016/02/feds-nail-webcam-on-utility-pole-for-10-weeks-to-spy-on-suspect/
The purpose would be to get rehearing to have the court reverse its
ruling that this kind of surveillance is constitutional. There is no
cost that I am aware of, as the brief is already written, we would
just be signing on.
I have a copy of the amicus brief if any LNC members would like to
read it in confidence. I need to decide if the Libertarian Party will
sign on prior to Monday, February 29 at 10:00 am, so I will likely
call a very short EC call for this weekend.
Yours truly,
Nick
