The difference was that in that case, the plaintiff was challenging federal
administrative action, not state law.  Likely not an important difference
in the outcome, though.  The outcome was that cert was denied, and the 9th
Circuit's decision (for the government) stood.  At least for now, this
fight seems limited to the political battlefield.
