[Lnc-business] Email Ballot 2018-22: PROPERTY RIGHTS RESOLUTION
Alex Merced (LNC Vice Chair)

I vote No on this motion and I hope the below will help make my thoughts clear on this matter and be useful in construction of future motions.
In accordance with the concerns expressed by the Chairman Sarwark I agree that this Motion by definition does one of two things, reaffirms What has already been affirmed by the platform in which case I rather vote on a Motion that uses the wording from the actual platform than paraphrasing it. If this is seen as an attempt to clarify what people feel isn’t clear then that seems like it should be the proper role of the platform committee to propose amendments for 2020 that will make it clearer. To the extent we conduct policy resolutions, I feel the proper role isn’t to clarify the platform but to apply it the issues of the day (showing how the platform applies to modern discussions of immigration, trade and spending such as the 82 billion of additional military spending)
As put forth by At-Large Rep Mattson I don’t disagree with the substance of the resolution. I do believe property rights are central not only libertarianism but to the functioning of civilization in the world of scarcity. I affirm property rights and many philosophical, economic and otherwise intellectual tenants of libertarianism regularly in my public and private communications. Although I do resent the framing of this to the public by proponents as a litmus test as if this resolution is the only mechanism for stating and affirming our principles and not doing so is tantamount to inviting a socialist mutiny... this kind of characterization is not something I want see in what should be a deliberative body and is enough to earn my no vote to push against such tactics. This concern has little to do the resolution but the tone of the conversation around this resolution on and off the LNC list.
As pointed out by Region 1 Alternate Bowden the way one can possibly read in room for Eminent Domain is unfortunate. I know 6 of you worked long and hard to get this wording and I appreciate that level of work and initiative but why would you make the mistake of rushing this to a vote without getting feedback further from the body in case one or two tweaks were needed (a mistake I’ve learned a few times now). The fact that I agree with the intention of this motion isn’t enough for me look pass its faults. When this first came up I tried to put in my two cents with some possible wording and approaches and then this was proposed almost the very next day.
In accordance with the concerns of At-Large Rep Bishop-Henchman this would be more concerning if a member of this body was espousing Syndicalist beliefs and that local candidates should be addressed directly by their state party. Although if we wanted to disabuse people of the idea that “Rent is Theft” and “Occupation is Ownership” there are much cleaner ways to do so which I will cite soon. I also agree we’d be better served affirming the platform applied to National issues so it can seem relevant and affirming.
I will not vote yes on any policy resolution that doesn’t reference actual National Policy Discussions until after the elections in November. So if we want to be speaking to our principles let’s do so in resolutions that our candidates can actually take to voters, otherwise these are things we can worry about for late November email ballots.
When November does come around and if we want to revisit this let me suggest something more straight to the point.
—————————-
Whereas section 2.1 of the Libertarian Party Reads as follows
“2.1 Property and Contract
As respect for property rights is fundamental to maintaining a free and prosperous society, it follows that the freedom to contract to obtain, retain, profit from, manage, or dispose of one’s property must also be upheld. Libertarians would free property owners from government restrictions on their rights to control and enjoy their property, as long as their choices do not harm or infringe on the rights of others. Eminent domain, civil asset forfeiture, governmental limits on profits, governmental production mandates, and governmental controls on prices of goods and services (including wages, rents, and interest) are abridgements of such fundamental rights. For voluntary dealings among private entities, parties should be free to choose with whom they trade and set whatever trade terms are mutually agreeable.”
It is resolved that rent is not theft and occupation is not ownership.
—————————
Bottom Line: I’m voting against this not so much for the substance of the motion but because it was rushed and the tactics used would set a bad tone for the next few years. For the record for the future, if the marketing of anyone’s motion creates such a divisive environment among members and becomes a distraction I will not hesitate to vote against it. It doesn’t mean we can’t try stuff like this but we need to communicate better with everyone to craft these things and not rush to riling people into a false dichotomy that any particular motion is an end all be all of any discussion.
Side note: I am putting forth such a long explanation of my vote to provide guidance so that the next attempt at this I can vote for because rent is not theft and property rights are a beautiful thing I want to vote Yes on. So please take my criticisms as intended as effort to make our resolutions better, stronger and effective to foster a united and principled front for the party.
To the framers of this resolution I do appreciate the hard work, I don’t want to discourage you from helping people understand what we believe in. I hope you’ll take what I had to say in stride and we can proceed forward a more cohesive, effective AND principled body.

-------------- next part --------------
I vote No on this motion and I hope the below will help make my
thoughts clear on this matter and be useful in construction of future
motions.
1. In accordance with the concerns expressed by the Chairman Sarwark I
agree that this Motion by definition does one of two things,
reaffirms What has already been affirmed by the platform in which
case I rather vote on a Motion that uses the wording from the
actual platform than paraphrasing it. If this is seen as an attempt
to clarify what people feel isn’t clear then that seems like it
should be the proper role of the platform committee to propose
amendments for 2020 that will make it clearer. To the extent we
conduct policy resolutions, I feel the proper role isn’t to clarify
the platform but to apply it the issues of the day (showing how the
platform applies to modern discussions of immigration, trade and
spending such as the 82 billion of additional military spending)
2. As put forth by At-Large Rep Mattson I don’t disagree with the
substance of the resolution. I do believe property rights are
central not only libertarianism but to the functioning of
civilization in the world of scarcity. I affirm property rights and
many philosophical, economic and otherwise intellectual tenants of
libertarianism regularly in my public and private communications.
Although I do resent the framing of this to the public by
proponents as a litmus test as if this resolution is the only
mechanism for stating and affirming our principles and not doing so
is tantamount to inviting a socialist mutiny... this kind of
characterization is not something I want see in what should be a
deliberative body and is enough to earn my no vote to push against
such tactics. This concern has little to do the resolution but the
tone of the conversation around this resolution on and off the LNC
list.
3. As pointed out by Region 1 Alternate Bowden the way one can
possibly read in room for Eminent Domain is unfortunate. I know 6
of you worked long and hard to get this wording and I appreciate
that level of work and initiative but why would you make the
mistake of rushing this to a vote without getting feedback further
from the body in case one or two tweaks were needed (a mistake I’ve
learned a few times now). The fact that I agree with the intention
of this motion isn’t enough for me look pass its faults. When this
first came up I tried to put in my two cents with some possible
wording and approaches and then this was proposed almost the very
next day.
4. In accordance with the concerns of At-Large Rep Bishop-Henchman
this would be more concerning if a member of this body was
espousing Syndicalist beliefs and that local candidates should be
addressed directly by their state party. Although if we wanted to
disabuse people of the idea that “Rent is Theft” and “Occupation is
Ownership” there are much cleaner ways to do so which I will cite
soon. I also agree we’d be better served affirming the platform
applied to National issues so it can seem relevant and affirming.
5. I will not vote yes on any policy resolution that doesn’t reference
actual National Policy Discussions until after the elections in
November. So if we want to be speaking to our principles let’s do
so in resolutions that our candidates can actually take to voters,
otherwise these are things we can worry about for late November
email ballots.
6. When November does come around and if we want to revisit this let
me suggest something more straight to the point.
—————————-
Whereas section 2.1 of the Libertarian Party Reads as follows
“2.1 Property and Contract
As respect for property rights is fundamental to maintaining a free and
prosperous society, it follows that the freedom to contract to obtain,
retain, profit from, manage, or dispose of one’s property must also be
upheld. Libertarians would free property owners from government
restrictions on their rights to control and enjoy their property, as
long as their choices do not harm or infringe on the rights of others.
Eminent domain, civil asset forfeiture, governmental limits on profits,
governmental production mandates, and governmental controls on prices
of goods and services (including wages, rents, and interest) are
abridgements of such fundamental rights. For voluntary dealings among
private entities, parties should be free to choose with whom they trade
and set whatever trade terms are mutually agreeable.”
It is resolved that rent is not theft and occupation is not ownership.
—————————
Bottom Line: I’m voting against this not so much for the substance of
the motion but because it was rushed and the tactics used would set a
bad tone for the next few years. For the record for the future, if the
marketing of anyone’s motion creates such a divisive environment among
members and becomes a distraction I will not hesitate to vote against
it. It doesn’t mean we can’t try stuff like this but we need to
communicate better with everyone to craft these things and not rush to
riling people into a false dichotomy that any particular motion is an
end all be all of any discussion.
Side note: I am putting forth such a long explanation of my vote to
provide guidance so that the next attempt at this I can vote for
because rent is not theft and property rights are a beautiful thing I
want to vote Yes on. So please take my criticisms as intended as effort
to make our resolutions better, stronger and effective to foster a
united and principled front for the party.
To the framers of this resolution I do appreciate the hard work, I
don’t want to discourage you from helping people understand what we
believe in. I hope you’ll take what I had to say in stride and we can
proceed forward a more cohesive, effective AND principled body.

I encounter people all the time who aren't sure

In the four days, Ms. Harlos has written and sent

They've decided this is their number one issue and

LNC's number one issue.
If we're looking to demonstrate Libertarian
relevance to
voters, I
would
instead suggest one of the following could be our
top
item
for
discussion, action, or marketing this week:
*China announces 25% tariffs on $60 billion worth
of
U.S.
goods, in
response to President Trump considering higher
tariffs
on
$200
billion
worth of Chinese goods. The total negative effect
of
enacted
and
announced tariffs in this tariff war is 465,000
lost
jobs
and
$150
billion less in economic growth.
*The U.S. Senate is poised to approve H.R. 6157,
which
increases
Pentagon spending to $675 billion for this upcoming
year.
While
federal
spending is being boosted, the U.S. Treasury is
expected
to
borrow
$955
billion this year, up from $519 billion last year.
*$1.7 billion was spent on lobbying in Washington,
DC in
the
first
six
months of this year, the highest since 2010. There
are
9,785
registered
lobbyists in the nation's capital, or 18 for each
member
of
Congress.
*Electric power was restored to the entire island
of
Puerto
Rico
today
for the first time since Hurricane Maria hit 328
days
ago,
a
woeful
testament to the commonwealth's dependence on the
federal
government.
*Wildfires continue to devastate northern
California,
destroying
thousands of homes and claiming 31 lives.
Regulations
prohibit
timber
companies from clearing out dense forests and
removing
an
estimated
129
million dead trees, leaving a tinder box.
*50 schoolchildren on a field trip were killed and
80
were
wounded
in a
Saudi airstrike in northern Yemen that hit their
bus
last
Thursday.
The
victims were age 6 to 11. U.S. Secretary of State
Pompeo,
on
the
phone
with the Saudi Crown Prince a few days later,
thanked
the
Saudis for
their help in Syria and Iraq.
*President Trump revoked the security clearance of
one
official
who
has
spoken out against him, and fired an FBI official
who
spoke out
against
him.
*California's Supreme Court struck down San Diego's
decision
(approved
by 65% of voters) to put city employees into a 401k
retirement
plan
instead of an antiquated and costly defined benefit
pension
plan. In
DC,
the WMATA transit agency lost a similar arbitration
dispute.
Taxpayers
will have to pick up the tab in both instances.
*Socialist Venezuela today defaulted on another
$1.125
billion
in
bonds.
Several dozen opposition figures have been rounded
up
for
"questioning"
following a drone assassination attempt on Maduro
earlier
this
month.
*New Zealand banned foreigners from buying property
as a
way of
"solving" high housing prices. U.S. cities may look
at
the
idea
next.
*North Dakota will vote on marijuana legalization,
after
LP
activist
Dave Owen and his org LegalizeND got the issue on
the
ballot
this
week.
*And of course, our many great candidates who need
donations,
volunteers, and attention as they work to be
elected and
re-elected.
Imagine how much money we could raise for them or
activists we
could
get
for them if we were e-mailing 68 times or posting
20
Facebook
posts
about them instead?
Relating to the last point, over the next few days
I'm
going to
personally donate $68 each - one for each of Ms.
Harlos's
emails
about
socialist entryism in the last four days - to ten
LP
candidates
in
winnable or ballot-access-important races across
the
country,
and
publicizing it to my network to encourage others to
give
as
well. If
all
27 of us were to do the same, that's an injection
of
$18,360
and a
clear
demonstration that this LNC has its priorities in
order.
If all
27
of us
were to get our networks to do the same, that may
make
the
difference
between winning and not winning. I welcome anyone
joining
me in
this
pledge, regardless of how they vote on this
resolution.
