If I were aware of some particular pressing need to know what state
affiliate X's bylaws were five years ago, this would have been a higher
priority for me. If some new situation were to arise, it would be much
more likely we would be interested in their current bylaws.
As I previously informed you, I intend to do this after I reorganize them
in a manner that will make more sense to someone besides me, and that
intent hasn't changed. After several years of my performance for the LNC,
there's no good reason to think that the only way to get me to take care of
a task is to demand updates from me on a public email lists, or to add
comments to the Secretary's Report incorrectly implying that I am causing
some sort of bylaw violation.
Your report for the upcoming meeting suggests that the archive is "required
by the national bylaws Article 5.2". Bylaw Article 5.2 is about how the
LNC initially charters a new affiliate. The sentence to which I presume
you are referring is:
"Affiliate party status shall be granted only to those organizations which
adopt the Statement of Principles and file a copy of their Constitution
and/or Bylaws with the Party Secretary."
The section as a whole is about actions taken at the time of initial
affiliation. The sentence itself says that filing a copy of governing
documents with the Party Secretary is a prerequisite for the LNC "granting"
affiliate status. I see nothing there about a recurring requirement to
maintain an archive of ever-changing affiliate bylaws after the point of
initial affiliation. Given that the document filing requirement is tied to
affiliate status, is it your position that all the affiliates who have not
regularly sent updates of their governing documents are no longer
affiliates?
I am not aware of any party secretary before me who spent time obtaining
and maintaining periodic copies of updated bylaws. I became concerned at
how frequently we have affiliates atrophy, and one affiliate even contacted
me because they had lost their bylaws after officer turnover. I did not
have a copy to provide back to them. So just in case, I started
periodically snagging copies from websites, or requesting copies if they
weren't on the website. I do not possess a history of state affiliate
bylaws from inception. It's an incomplete (not all state affiliates would
respond to my requests) set of data starting during my tenure as party
secretary.
The files aren't going anywhere. I have them on two computers, plus in an
offsite backup. Staff has an older version that I sent them maybe three
years ago. I still plan to reorganize them and then share a copy, but it
is not urgent, and drumming up drama about it is just unwarranted. I do
not feel guilty for having put other projects ahead of this task.
