Darryl Perry expresses surprise in the comments at BAN that Clint Bolick (recently of the libertarian Institute for Justice and now appointed as a member of that court, iirc) did not issue a dissenting opinion, and I wonder about that too. But I'm not quite clear from either your message or from BAN what's at stake in the District Court case that you mention, or what relation it has to the Arizona Supreme Court case.
