Mr. Treasurer:

 

Thank you for looking that up.

 

It depends on the meaning of the word "participate".  If the proceeds of a
joint fundraiser are deposited into one account, and then that entity makes
out a check to the other organization, I assume that would be defined as
"participating."

 

 

However, as the Chair and myself envision it, a donor would have to make two
separate "clicks":  one on our web site, and another on the other
organization's web site (perhaps on a frame on our web site).  Neither
organization would ever have possession of the funds destined for the other
organization.


I still think this question would be a good one for our FEC consultant.

Doubtful, unless the regulations have changed. From the Campaign Guide for
Political Party Committees (www.fec.gov/pdf/partygui.pdf), page 131:


Soft Money Ban

 

National party committees may not participate in any joint fundraiser where
nonfederal or Levin funds are raised. 300.10.

 

 

The citation at the end is to Title 11 of the Code of Federal Regulations,
Part 300, Section 10. This section also applies to an officer or agent
acting on behalf of a national party committee or a national congressional
campaign committee; and an entity that is directly or indirectly
established, financed, maintained, or controlled by a national party
committee or a national congressional campaign committee.

As you have seen, there is a demand from our affiliates for some way of
maximizing the number of people who join the LP at both the state and
national levels.

 

I assume this has been looked at before, but just in case.

 

Is this a way for us to jointly raise money with non-FEC-filing entities?

"Joint fundraising is fundraising conducted jointly by a political committee
and one or more other political committees or unregistered organizations.
Joint fundraising rules apply to:

*	1Party committees;
*	Party organizations not registered as political committees;
*	Federal and/or nonfederal candidate committees;
*	Nonparty, unauthorized political committees (nonconnected PACs); and
*	Unregistered nonparty organizations. 11 CFR 102.17(a)(1)(i) and
(2)."

 

At some point we might want to ask this question of our FEC consultant.  Or,
we might want to ask the consultant if they can think of a way of legally
accomplishing what we are trying to do.
